Rule 4.2 of the Rules of Professional Conduct restricts attorneys from certain communications with persons known to be represented by counsel. The panel will review the differences among the DC, MD and VA versions of Rule 4.2, and its application to corporate and government officials and former employees. Discussion will cover advising a client about communications with represented parties and managing communications when a person’s role is unknown or uncertain. The panel will also present suggestions for addressing claims that a communication violated Rule 4.2.

This program will focus on post-verdict injunctive relief in employment discrimination cases and how to help your client obtain “make whole” relief from discrimination. Michal Shinnar, Jacob Small, Leizer Goldsmith and Ben Inman will discuss these topics based on a successful jury verdict and subsequent decision granting injunctive relief in the Burke v. Mattis case in the EDVA. Among other topics, they will discuss the type of relief a court can award against the federal government versus a private employer and the means and methods for requesting such relief in the settlement process.

The opening statement is a plaintiff’s chance to frame an entire case and sometimes can seal a case. Too often, it’s a last-minute afterthought and becomes a rote recitation of facts. This seminar will focus on the power of a persuasive open and how to construct one. It will feature a comparison between the opening statement in Makray v. Perez and a YouTube posting by one of the jurors. The vlog gives a unique insight into the deliberations and how they were influenced by the opening statement.  It’s a one of a kind “inside baseball” look.

Nancy Barsky, LCSW, will present her program given earlier this year to the DC Trial Lawyers Association on the range of psychological profiles she encounters in her practice and identify certain characteristics and traits that may be exhibited. Ms. Barsky will provide practical advice and tips on how to best manage representation depending on the clients’ personality traits and characteristics.
