Rule 4.2 of the Rules of Professional Conduct restricts attorneys from certain communications with persons known to be represented by counsel. The panel will review the differences among the DC, MD and VA versions of Rule 4.2, and its application to corporate and government officials and former employees. Discussion will cover advising a client about communications with represented parties and managing communications when a person’s role is unknown or uncertain. The panel will also present suggestions for addressing claims that a communication violated Rule 4.2.
